An affidavit having been filed that the Plaintiff used due diligence to locate Defendant Susan H. Simpkins, Trustee, but without effect; that the last known post office address of Defendant Susan H. Simpkins, Trustee is 248 Barnes Road, Suffolk, VA 23437, and the Plaintiff has used due diligence to ascertain any other location for her, but without effect; that the Plaintiff used due diligence to locate Defendant Robert H. Johnson, Trustee, but without effect; that the last post office address of Defendant Robert H. Johnson, Trustee is unknown; that the Plaintiff served Defendant Jesse J. Johnson, Jr., Trustee by substitute service of a family member at his last known post office address of 3508 Robs Drive, Suffolk, VA 23434 and has used due diligence to ascertain any other location for him, but without effect.

            It is ORDERED that this Order be published at least once a week for two successive weeks in the Smithfield Times, a newspaper of general circulation in Isle of Wight, Virginia, and that the parties named herein appear at 10 a.m. December 2, 2015, in the Isle of Wight Circuit Court Clerk’s Office and do what may be necessary to protect their respective interests.

TERMS OF SALE:  The property will be sold “AS IS,” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust to be announced at the time of sale.  A deposit of $20,000.00, or 10% of the sale price, whichever is lower, in cash or cashier’s check payable to the SUBSTITUTE TRUSTEE will be required at the time of sale.  The balance of the purchase price, with interest at the rate contained in the Deed of Trust Note from the date of sale to the date said funds are received in the office of the SUBSTITUTE TRUSTEE, will be due within fifteen (15) days of sale.  In the event of default by the successful bidder, the entire deposit shall be forfeited and applied to the costs and expenses of sale and Substitute Trustee’s fee.  All other public charges or assessments, including water/sewer charges, whether incurred prior to or after the sale, and all other costs incident to settlement to be paid by the purchaser. In the event taxes, any other public charges have been advanced, a credit will be due to the seller, to be adjusted from the date of sale at the time of settlement.  Purchaser agrees to pay the seller’s attorneys at settlement, a fee of $445.00 for review of the settlement documents.

Additional terms will be announced at the time of sale and the successful bidder will be required to execute and deliver to the Substitute Trustees a memorandum or contract of the sale at the conclusion of bidding.

NOTICE OF PUBLIC HEARING

TOWN COUNCIL OF THE TOWN OF SMITHFIELD

AMENDMENT OF ZONING ORDINANCE

            Notice is hereby given pursuant to Sections 15.2-2204 and 15.2-2285 of the Code of Virginia, (1950), as amended, that the Town Council of the Town of Smithfield, Virginia will hold a public hearing at the regular meeting of the Town Council on Tuesday, December 1,  2015 at 7:30 o’clock P.M., in the council chambers in The Smithfield Center, 220 N. Church Street, meeting room A, Smithfield, Virginia to consider the amendment of certain provisions of the Town’s Zoning Ordinance.  A proposed amendment of the Zoning Ordinance is the repeal and readoption of the following article of the ordinance: Article 3.O., FP-O, Floodplain Overlay District; and a further proposed amendment of the Zoning Ordinance is the amendment of Article 13., Definitions to include specific definitions necessary and appropriate for the administration and enforcement of the provisions of Article 3.O., FP-O, Floodplain Overlay District as proposed.

            Copies of the current Zoning Ordinance for Smithfield, Virginia, adopted September 1, 1998, and all amendments thereto, along with copies of the proposed amendment of the Zoning Ordinance for Smithfield, Virginia are on file and may be examined in the office of

the Department of Planning, Engineering, & Public Works, 310 Institute Street, Smithfield, Virginia 23430.

Public Notice – Environmental Permit

 

PURPOSE OF NOTICE: To seek public comment on the proposal to utilize an alternate groundwater point of compliance (APC) at the below-described solid waste landfill with a permit issued from the Department of Environmental Quality.

 

PUBLIC COMMENT PERIOD: 30 days total, extending from November 18, 2015 to December 18, 2015

 

PERMIT NAME:  Isle of Wight County Landfill (Permit Number 087)

 

FACILITY NAME AND LOCATION:  Isle of Wight County Landfill, 11213 Woody Acres Way, Smithfield, Virginia 23430    

 

VARIANCE DESCRIPTION: The landfill has requested a Variance to locate one of its groundwater monitoring wells somewhere other than at the edge of the landfill waste mass as is normally required by the Commonwealth’s solid waste regulations.  The applicant has demonstrated that moving the location of the monitoring wells further from the edge of the waste mass will not result in an unreasonable risk to public health or the environment and will result in facility design that is equally protective of human health and the environment.  If approved, this Variance will allow the facility to locate MW-1R approximately 180 feet downgradient from the edge of the waste mass, but the well will remain located on landfill property.  

 

HOW TO COMMENT: DEQ accepts comments on this proposed decision by e-mail, fax or postal mail. All comments must include the name, address and telephone number of the person commenting and be received by DEQ within the 30-day comment period. The public may review all related Variance petition documents at the DEQ Regional office named below.
