The object of the above styled suit is to partition real property situate, lying and being in Isle of Wight County, Virginia identified as Tax Map Parcel No. 18-01-011, and said to contain 78 acres; Tax Map Parcel No. 18-01-016, and said to contain 9.76 acres; Tax Map Parcel No.
38A-01-047, commonly known as 17041 South Carolina Avenue, Windsor, Virginia and Tax Map Parcel No. 38A-01-048, commonly known as 22160 South Carolina Avenue, Windsor, Virginia.

AND IT APPEARING by Affidavit filed according to law that the above named Defendants cannot be found and that diligence has been used without effect to ascertain the location of the parties to be served or as set out in the pleadings they are a person or persons, as Defendants by the general description of “Parties Unknown” it is therefore ordered that the unknown heirs, assigns, devisees or grantees of Walter L. Clarke, any there may be, and all other persons who may be interested in the subject matter of this suit whose names and whereabouts are unknown, all of whom are made parties hereto under the general description of “PARTIES UNKNOWN”, whether of record or not, in Tax Map Parcel No. 18-01-011, 18-01-016, 38A-01- 047 and 38A-0l-048 appear on or before the 16th day of February, 2018 in the Clerk’s Office of this Court and do what is necessary to protect their interest.
AND IT IS FURTHER ORDERED that this Order be published once a week for four successive weeks in the Smithfield Times, a newspaper of general circulation in the County of Isle of Wight; that a copy of this Order be posted at the front door of the courthouse wherein this court is held; and that a copy of this Order be mailed to the Defendants at the addresses shown by the aforesaid Affidavit, if any.

NOTICE OF PUBLIC HEARING

THE TOWN OF SMITHFIELD BOARD OF ZONING APPEALS
SPECIAL YARD EXCEPTION

Notice is hereby given that the Board of Zoning Appeals of the Town of Smithfield, Virginia, will hold a public hearing at the regular meeting of the Board of Zoning Appeals in the council chambers in The Smithfield Center, 220 N. Church Street, Smithfield, Virginia, in meeting room A, on Tuesday, January 16, 2018, at 7:30 p.m. to consider the application of Christopher Powell and Melissa Powell, owners, for a special yard exception under the provisions of Article 12, Section D of the Zoning Ordinance of the Town of Smithfield, Virginia, adopted September 1, 1998, and as amended thereafter, in order to approve a proposed garage addition attached to an existing dwelling with a rear yard setback of 26.4 feet. The proposed addition will violate the required setback provisions of the zoning ordinance and the Special Yard Exception will cure the violation. The property is located at 226 Moonefield Drive. The minimum rear yard setback for this lot is 35 feet, as provided by the Zoning Ordinance. The subject property is zoned N-R, Neighborhood -Residential.
Any person affected by or interested in the aforesaid application may appear at the hearing and be heard. Copies of the Zoning Ordinance of the Town of Smithfield and application for this special yard exception are available for inspection in the office of the Department of Planning, Engineering, & Public Works, 310 Institute Street, Smithfield, Virginia 23430.

Notice is hereby given that the Isle of Wight County Board of Supervisors will hold a Public Hearing on Thursday, January 18, 2018 to consider the following:

The application of Michael J. Putman, owner and applicant, for a Conditional Use Permit on a parcel totaling .24 acre, Tax Parcel Identification Number 69D-01-001, located at 33382 Lees Mill Road. The purpose of the application is to allow for a “dwelling, two-family” (duplex) on property that is zoned Rural Agricultural Conservation (RAC).

The application of Jimmy Ferguson, owner, and Maurice Deshazo, applicant, for a Conditional Use Permit on 1.09 acres out of a 1.95 acre parcel, Tax Parcel Identification Number 34-01-008C, located at 14170 Carrollton Boulevard. The purpose of the application is to allow for a “motor vehicle dealership, used” to be operated on the site currently zoned General Commercial (GC).

The application of Elliott Cohen, owner, and the Community Empowerment Center, applicant, for a Conditional Use Permit on 4.46 acres, located at 15042 Carrollton Boulevard, Tax Parcel Identification Number 34-07-000B. The purpose of the application is to allow for “religious assembly” to be operated on the site zoned General Commercial (GC).

The application of Bobby G Buie, owner, and Zeno D. Smith on behalf of D. Smith Property Inc., applicant, for a Conditional Use Permit on 2 acres, Tax Parcel Identification Number 03-01-042, on Fort Huger Drive. The purpose of the application is to allow for a “construction yard” to be operated on the site zoned Rural Agricultural Conservation (RAC).

The application of East West – Benn’s Grant, LLC, applicant, and East West – Benn’s Grant, LLC, Benn’s Church Properties, and Turner Farms, Inc., owners, for amendment to conditional zoning of 26.43 acres of land located at 15150 Benn’s Church Boulevard, on the property with tax map numbers 32-01-082 and 32-01-075A. The purpose of the application is to convert a portion of the designated commercial property and open space area to allow for 231 additional residential units.

Copies of said applications are on file in the Department of Planning and Zoning at the Isle of Wight County Courthouse Complex, Isle of Wight, Virginia, and are available for public examination.

Any person desiring to be heard in favor of, in opposition to, or to express his or her views with respect to said applications may appear before and be heard by said Board of Supervisors during the Public Hearing to be held in the Robert C. Claud, Sr. Board Room at the Isle of Wight County Courthouse Complex on Thursday, January 18, 2018. The public meeting is scheduled to start at 6:00 p.m.
