TERMS OF SALE:  The property will be sold “AS IS,” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust to be announced at the time of sale.  A deposit of $20,000.00, or 10% of the sale price, whichever is lower, in cash or cashier’s check payable to the SUBSTITUTE TRUSTEE will be required at the time of sale.  The balance of the purchase price, with interest at the rate contained in the Deed of Trust Note from the date of sale to the date said funds are received in the office of the SUBSTITUTE TRUSTEE, will be due within fifteen (15) days of sale.  In the event of default by the successful bidder, the entire deposit shall be forfeited and applied to the costs and expenses of sale and Substitute Trustee’s fee.  All other public charges or assessments, including water/sewer charges, whether incurred prior to or after the sale, and all other costs incident to settlement to be paid by the purchaser. In the event taxes, any other public charges have been advanced, a credit will be due to the seller, to be adjusted from the date of sale at the time of settlement.  Purchaser agrees to pay the seller’s attorneys at settlement, a fee of $445.00 for review of the settlement documents.

Additional terms will be announced at the time of sale and the successful bidder will be required to execute and deliver to the Substitute Trustees a memorandum or contract of the sale at the conclusion of bidding.

                        PLANNING COMMISSION OF THE TOWN OF SMITHFIELD

                                      AMENDMENT OF COMPREHENSIVE PLAN

            Notice is hereby given pursuant to Sections 15.2-2204 of the Code of Virginia, (1950), as amended, that the Planning Commission of the Town of Smithfield, Virginia will hold a public hearing at the regular meeting of the Planning Commission on Tuesday, April 12, 2016 at 6:30 o’clock P.M., in the council chambers in The Smithfield Center, 220 N. Church Street, meeting room A, Smithfield, Virginia, to consider the application of the Town of Smithfield, owner, for an amendment to Chapter VI – Future Land Use Plan of the Comprehensive Plan of the Town of Smithfield pursuant to the provisions of Section 15.2-2229 of the Code of Virginia, (1950), as amended.

             The proposed amendment of the Comprehensive Plan proposes a change in the future land use designations on the map attachment to the Future Land Use Plan.  The property which is the object of this application is the Little Farm located on West Main Street at its intersection with Water Works Road. (Tax Map #21-01-051, #21-01-051A, and #21-01-051B) containing 97.50+/- acres.

            The current future land use designation for these parcels is Low Density Residential as to 75.250 +/- acres and Retail Commercial as to 22+/- acres.  The applicant proposes a change to the future land use designation for the tract to 72+/- acres as Parks & Recreation and 25.25+/- acres as Retail Commercial.

            Copies of the current Comprehensive Plan for Smithfield, Virginia, and all amendments thereto, along with copies of the proposed amendment to the Comprehensive Plan for Smithfield, Virginia, are on file and may be examined in the office of the Department of Planning, Engineering, & Public Works, 302 Main Street, Smithfield, Virginia.

                                                          SPECIAL USE PERMIT

 

 

            Notice is hereby given that the Planning Commission of the Town of Smithfield, Virginia, will hold a public hearing at the regular meeting of the Planning Commission in the council chambers in The Smithfield Center, 220 N. Church Street, meeting room A, Smithfield, Virginia, on Tuesday, April 12, 2016 at 6:30 p.m. to consider the application of the trustees of Hope Presbyterian Church, owners, for a special use permit under the provisions of Article 3.I., Sections C., and Article 6 of the Zoning Ordinance of the Town of Smithfield, Virginia, adopted September 1, 1998, and as amended thereafter, in order to approve the use of a portion of the church facility as an indoor commercial recreation facility.  The property which is the subject of this special use permit is located at 13490 Benn’s Church Boulevard.  The property in question is zoned HR-C, Highway Retail Commercial District.

Notice is hereby given that the Board of Supervisors, at its meeting on Thursday, April 21, 2016, will hold a public hearing to consider an ordinance to revise and reenact Chapter 6, Erosion and Sedimentation Control.  The purpose of the ordinance is to make technical revisions to comply with state law.  A copy of the proposed ordinance is on file in the Office of the County Attorney and the Office of the County Administrator, Isle of Wight Courthouse, Isle of Wight County, Virginia, and is available for public inspection.  Any person desiring to be heard in favor of, in opposition to, or to express his views with respect to the proposed sale may appear before, and be heard by, the Board during the Public Hearing in the Robert C. Notice is hereby given that the Isle of Wight County Board of Supervisors will hold a Public Hearing on Thursday, April 21, 2016 to consider the following: 

 

The application of Todd and Sally Bristol, owners and applicants, for a Conditional Use Permit (CUP) on 3.334 acres of land located at 101 Deer Run Drive in the Windsor Election District. The purpose of the application is to allow for an accessory apartment in the Neighborhood Conservation (NC) zoning district.

 

The application of Robert and Sandra Faison for exceptions to the Chesapeake Bay Preservation Area Ordinance. Specifically, Section 4002 to allow encroachment into the 100-foot-wide Resource Protection Area buffer to build a single-family home on Lot 25 on Shivers Mill Lane in Carrollton, in the Newport Election District, and to allow for a reduction in the amount of required landscaping mitigation.

 

The application of Accelerated Properties, LLC (Anthony Stile and Joshua Tawes), owners, for conditional zoning of 12.655 acres of land located at 1 Monette Parkway, 39 Monette Parkway and 55 Monette Parkway in the Smithfield Election District. The purpose of the application is to change the zoning classification from Conditional – Limited Industrial (LI), Conditional – General Commercial (GC) and Rural Agricultural Conservation (RAC) to Conditional General Commercial (C-GC) and amend the permitted uses on the property.

 

An ordinance to amend and reenact the Isle of Wight County Code by amending and reenacting Appendix B, Zoning: Article III, Use Types; Section 3-7000, Industrial Use Types, in order to add a definition for “towing service storage yard”.

 

A resolution to amend the Comprehensive Plan of Isle of Wight County, Virginia through changes to the text and maps in Chapter 4, “Growth Management and Land Use”. The purpose for these changes is to include the Resource Conservation Land Use in all appropriate locations in the Comprehensive Plan.

 

An ordinance to amend and reenact the following sections of the Isle of Wight County Code by amending and reenacting Appendix B, Zoning: Article VIII, Landscaping and Screening Standards; in order to make revisions for clarity of language, flexibility of application, and enhanced tree preservation

 

Copies of said applications and ordinance amendments are on file in the Department of Planning and Zoning at the Isle of Wight County Courthouse Complex, Isle of Wight, Virginia, and are available for public examination.
