The object of this suit is to effect partition amongst the owners by sale or otherwise of real property which Malachi Lawrence died seized and possessed, and intestate on December 20, 1969. The property is located in Isle of Wight County, Virginia, and is known as Tax Map 48-01-042, located at 22196 Orbit Rd., Windsor, VA 23487.
An affidavit having been made that the whereabouts and post office address of Charles Lawrence, Fatima Muhammad (f/k/a Deborah Lawrence), Stacey Lawrence and Stanley Lawrence are unknown; that Jeffrey Lawrence and Bernard Lunon are nonresidents of the State of Virginia, and that their last known post office addresses are as indicated above; and that the last known post office addresses of Henry Lawrence, John C. Lawrence, Chester C. Lawrence, Charles Lawrence, Fatima Muhammad, f/k/a Deborah Lawrence, Bertha Lunon Lawrence, Lester Lawrence, Stacey Lawrence, Stanley Lawrence, and Antonio Lawrence, if living, are unknown, and the Complaint stating that there are or may be person interested in the property to be divided whose names and last post office addresses are unknown, such unknown parties being the widower and heirs, devisees and successors in title of Henry Lawrence, John C. AMENDMENT TO PROFFERED CONDITIONS
Notice is hereby given pursuant to Sections 15.2-2204 of the Code of Virginia, (1950), as amended, that the Town Council of the Town of Smithfield, Virginia will hold a public hearing at the regular meeting of the Town Council in the council chambers in The Smithfield Center, 220 N. Church Street, meeting room A, Smithfield, Virginia, on Tuesday, November 7, 2017 at 7:30 p.m. to consider the application of Cypress Investment Holdings, LLC, owner, for an amendment to the current zoning ordinance to amend the proffered conditions attendant to the original approved change in zoning classification of certain property now zoned (S-R), Suburban Residential (Conditional).
The proposed changes in the proffered conditions will provide for: 1. Removal of 24 townhomes. 2. Increase of the maximum number of units from 450 to 518 (68 additional units). 3. Inclusion of 91 age-restricted units. 4. Replacement of references to ‘environmental’ with ‘architectural’ review board. 5. Removal of 40–50 boat slips. 6. Removal of the build-out timeframe. 7. Inclusion of the Design Guidelines for the proposed Phase VI. 8. Setback requirements in Phase VI that exceed the minimums in the town ordinance. 9. Assurances as to the timeframe of the provision of planned amenities in Phase VI.
The property which is the subject of this application is all of the Cypress Creek Subdivision within the Town of Smithfield, being that area bounded by the Route 10 Bypass, Fairway Drive, Great Springs Road, the Town of Smithfield Boundary and Cypress Creek. The application of Bay Sand Company, Inc., applicant, and Everets Properties, Inc./Charles H. Rose and Lynn K.
