TERMS OF SALE: CASH. The Property is to be sold "AS IS" and "WITH ALL FAULTS", without any representations or warranties, SUBJECT TO the rights of any person(s) in possession, to the extent any such rights exist and have priority over the Deed of Trust, and to any covenants, conditions, restrictions, easements, defects, encumbrances, adverse claim, and liens, whether recorded or inchoate, that have priority over the Deed of Trust. An affidavit having been filed that the Plaintiff used due diligence to locate Wanda Wells Hewitt, if living, but without effect; that the last known post office addresses of Wanda Wells Hewitt, if living, are 12096 Burwells Bay Road, Smithfield, VA 23430 & 8195 Moonlight Road, Smithfield, VA 23430; that if Wanda Wells Hewitt is not living, the Plaintiff used due diligence to locate her unknown heirs, devisees and successors in interest; that the post office addresses of the unknown heirs, devisees and successors in interest of Wanda Wells Hewitt are unknown; and that there may be other persons having an interest in the property whose names and addresses are unknown, and those claiming through the aforementioned parties, all such persons made defendants as “Parties Unknown.”
